The Allahabad High Court has sought a response from the Basic Education Council and the state government by June 10 on the cancellation of transfer of teachers who had made mistake in filling the deployment in urban or rural areas in the online application for transfer.
This order has been given by Justice MC Tripathi after hearing advocate Seemant Singh on the petitions of Reena Upadhyay and others. Advocate Seemant Singh said that under the mandate of inter-state transfer issued in December 2019, the petitioners applied from the districts of Santakbirnagar, Maharajganj etc. The petitioners erroneously showed their appointment in the urban area in the online application while they were posted in the rural area. He was getting HRA equivalent to urban area. The Basic Education Officer also certified the application. After this, the petitioners were transferred to Gorakhpur, where they also joined. Later on 11 February 2021, a mandate was issued that the teachers who have mistakenly filled the urban area instead of rural in their application, should be shifted from the urban area to the rural area. Also, the concerned BSA should confirm where the teacher was appointed.
After this mandate, BSA Gorakhpur canceled the transfer of the petitioners and sent them back to the original districts. The petition stated that due to incorrect filling of urban or rural areas, there has been no change in their transfer weight, hence the BSA does not have the right to cancel the transfer.
